The Public Prosecution has amended its provisional conclusions in the trial against individuals accused of breaking into a dating apartment in Gijón, assaulting the woman running the business, and, after taking the keys to her home, going to her house and stealing jewelry, belongings, and 20,000 euros in cash.

Originally, the charges were against two men, one of whom is currently in rebellion. However, at the end of the trial, an accusation was also made against a woman by the private prosecution.

According to a press release from the Public Prosecution, after the evidence presented at the trial, the prosecutor considers her to be a co-author of a robbery with violence offense under articles 242.1 and 242.2 of the Penal Code (committed in the dating apartment) and an accomplice to a burglary offense under articles 240 and 241.1 of the same legal text (committed in the woman’s home who ran the business).

For the first offense, the prosecutor has requested a sentence of five years in prison with a special disqualification from the right to vote passive during the time of the sentence; and for the second offense, a sentence of four years in prison with special disqualification from the right to vote passive during the time of the sentence.

Furthermore, the Public Prosecution has attributed to the accused, in addition to the two offenses he was charged with – robbery with violence and burglary -, an offense of injuries under article 147.1 of the Penal Code.

For this offense, the prosecutor has requested a sentence of one year and nine months in prison, with special disqualification from the right to vote passive during the time of the sentence.

Regarding the other two offenses, the Public Prosecution has maintained its initial request for a sentence: for the offense of robbery with violence, five years in prison with special disqualification from the right to vote passive during the time of the sentence, and for the offense of burglary, four years in prison with special disqualification from the right to vote passive during the time of the sentence.

Pursuant to article 89 of the Penal Code, the substitution of the prison sentence requested for the offense of robbery with violence by the expulsion of the accused from Spanish territory for ten years is requested.

In terms of civil liabilities, the Public Prosecution has added to the 840 euros requested for the injuries caused to the victim, an additional 2,000 euros for the sequelae.

In addition to these amounts, compensation is also requested for the woman running the dating apartment with 20,000 euros for the stolen cash, as well as the amount proven for the value of the stolen items. Likewise, an amount of 120 euros is requested to be paid to one of the women present in the apartment. The rest of the provisional charges remain unchanged.

Regarding the account of events, the Public Prosecution maintains that, on the morning of August 28, 2020, the accused (La Habana, 1995; Caracas, 1992) entered a dating apartment that was open to the public on Ezcurdia Street in Gijón.

Once inside, they beat and tied up the woman running the establishment, leaving her locked in a room. They then went to the living room, where three other women were, from whom they stole their purses and tied them up.

Subsequently, the accused took the victim’s house keys from her purse and handed them to unknown individuals, who – at the command of the former – went to the woman’s home, from where they stole jewelry, 20,000 euros in cash, backpacks, glasses, purses, and other unvalued items.

The victim suffered bruises and hematomas, which healed in 21 days. One of the women in the apartment had 120 euros stolen from her purse.
