The Police Local of Castrillón will seal off the surf school that operates in Salinas irregularly, without the necessary licenses for teaching surf on the beaches of the municipality or for the use of the property as a tourist hostel, as reported by the Castrillón City Council, which states that an urgent court order in response to the request made through the Contentious/Administrative route authorizes the entry of the local administration into the property located at number 1 Bernardo Álvarez Galán Street in Salinas for the closure of the activity.
From the Council, they emphasize that the judge of the court understands that the seal requested by the Castrillón City Council is «fully reasonable» after reviewing the documentation, «given the clear rebellious intent of the administrators to comply with the order, which is nothing more than the closure of a clandestine activity.»
Likewise, as reported by the City Council, the document explains that the need and urgency of the requested measure is reinforced by specific legislation for the protection of minors, as there are minors staying at the establishment.
Castrillón Local Police officers informed the property owner of the judicial authorization on Wednesday afternoon. The local administration will give the establishment until next week to communicate the measure to the families of minors who are currently staying at the establishment, so that they can pick them up during these days, or for those who had reservations for the coming days to proceed with their cancellation.
In addition, the police officers requested a list of contacts for these families, so that they could also be informed of the seal by the administration.
The file on the limited company that owns the property began in July 2023 following a report by the Civil Guard. The Municipal Technical Office found that there was no license in the property affected by the judicial resolution for the operation of a tourist hostel, a surf school, or any other activity.
In September of the following year, and after failing to regularize the activity, a resolution from the Mayor’s Office was issued ordering the cessation of the activity. After the break at the end of the summer season and confirming that the property was still in operation, in June of this year, a letter was received from the Department of Tourism informing that the establishment was acting outside the law as it was not listed in the Register of Tourism Companies and Activities.
That same month, the closure of the activity was agreed upon through forced execution, with the cutting off of supplies as a precautionary measure, by a resolution from the Mayor’s Office. After the individuals in the property prevented the seal on June 30, a judicial order was requested that now authorizes it.
The Ordinance on the Use and Enjoyment of the Beaches of Castrillón of August 10, 2017, regulates the teaching of surfing on the beaches of the municipality and establishes in sections 4 and 5 of article 13 the need to have the appropriate municipal authorization for this activity.
