Tres personas juzgadas por estafa y abuso sexual a vecina de Gijón dejada en la ruina

La víctima ended up with less than two euros in her bank account even after selling her house

The Area Prosecutor’s Office of Gijón is requesting the conviction of three defendants, two men born in 1982 and 1976, and a woman born in 1982, for the fraud and sexual abuse suffered by a neighbor of Gijón, who ended up with less than two euros in her bank account even after selling her house.

The oral hearing, held on Thursday and Friday behind closed doors in the Eighth Section of the Provincial Court of Asturias based in Gijón, was adjourned for sentencing.

According to a press release from the Public Prosecutor’s Office, in early 2019, the victim (born in 1968) met one of the accused in Gijón, who told her that he had nowhere to live and that his mother was very ill.

In this situation, the woman offered to accommodate him in her home, even providing him with the keys to the property. During the time the defendant lived with her, approximately a year, she took the opportunity to steal various items and gold jewelry from him, valued at €7,128.71. During that time, she also mistreated the woman.

Additionally, in April 2019, the defendant and the victim traveled to Madrid by taxi, with her paying for the fare, where he convinced her to apply for a loan of €25,600 on the 11th of that month, using her house in Gijón as collateral.

The defendant, knowing that she could not meet the payments, kept all the money and when she demanded it back, he told her it was in a safe place.

Due to her «extreme» financial situation, the victim sold her house and, after settling the loan and community payments, she deposited €55,731.19 into her account on February 17, 2020.

ACCOUNT DRAINING

However, as the defendant was authorized on the account, having previously coerced the woman to achieve this, he withdrew the cash without her knowledge or consent. As of April 10, 2021, the balance in the bank was €1.78.

The woman filed a complaint on April 14, 2021, accompanied by a neighbor who took her into her home as she had nowhere to stay.

Furthermore, in 2019, on unspecified dates, the other defendant, a friend of the first one who knew that the latter lived in the woman’s house, and in collusion with him, went to the house and, aware that the victim was a «vulnerable person with a medium/low level of intelligence,» sexually abused her on two occasions.

Additionally, the first defendant was in a romantic relationship with the woman accused in this case at that time, and in order to share the profits, they sold the victim’s jewelry in various establishments in Gijón.

The Public Prosecutor’s Office accuses the first defendant of theft under articles 234.1 and 74; a continued offense of threats under articles 169.3 and 74; a minor offense of injuries under 147.2; and a continued offense of fraud under articles 248, 249, and 250.1 and 4, all of the Penal Code.

As for the other defendant, he is charged with a continued offense of sexual abuse under article 181.4 and 5, in relation to 180.3 of the Penal Code. The Public Prosecutor’s Office, in the case of the woman being tried, accuses her of receiving stolen property under article 298.1 of the Penal Code.

The first defendant is facing two years in prison for the first offense, 18 months in prison for the second, two months of fines with a daily rate of ten euros for the third, and five years in prison for the fifth, as well as a fine for 20 months with a daily rate of ten euros.

Regarding the second defendant, the Public Prosecutor’s Office requests nine years in prison and seven years of supervised release, while asking for a year and a half in prison for the accused woman.

In addition to the payment of court costs, the Public Prosecutor’s Office requests that the defendants compensate the victim for the moral damages and economic losses suffered, plus the corresponding legal interests.
