The magistrate of the Court of Instruction number 3 in Oviedo has ordered the provisional imprisonment, communicated and without bail, of the married couple arrested for allegedly keeping their three children locked up in a single-family home in the municipality of Oviedo, in accordance with the request of the Public Prosecutor’s Office.
After questioning the two detainees, the judge has ruled for their imprisonment, as well as the suspension of parental authority and custody, which will now be under the responsibility of the Government of the Principality of Asturias.
According to the Superior Court of Justice of Asturias (TSJA), the proceedings are opened for domestic violence, with habitual psychological abuse and child neglect, possibly also constituting the crime of «illegal detention». The detainees will be transferred «immediately» to the penitentiary center of Asturias.
THE REQUEST FROM THE PROSECUTOR’S OFFICE
The Public Prosecutor’s Office requested the court for precautionary measures considering the risk of flight and to ensure the protection of the minors. Without prejudice to the development of the proceedings, the Prosecutor’s Office believes that the facts could constitute the crimes of illegal detention, family abandonment, and habitual psychological abuse. The Court will issue the corresponding ruling on this matter.
As it has been reported, the operation was carried out thanks to a neighbor’s alert. The Local Police informed the Public Prosecutor’s Office of the Principality of Asturias, and after a meeting with the Senior Prosecutor, María Eugenia Prendes, the case was transferred to the Minors Section, where – in communication with the Minor’s Lawyer – proceedings were initiated to assess the situation of the three children.
In the context of this case, the Coordinator Prosecutor for Minors, Jorge Fernández Caldevilla, instructed the Judicial Police Unit of the Local Police in Oviedo to conduct the necessary investigations regarding the condition of the minors.
