The Superior Court of Justice of Asturias (TSJA) has confirmed the sentence by which the former president of the Principality and former vice president of the Government, Francisco Álvarez-Cascos, was acquitted of the continuous crime of misappropriation he was accused of for allegedly charging improper expenses to the party he founded, Foro Asturias.
In this way, the sentence issued by the TSJA, which is appealable, confirms the ruling issued on February 4 by the Third Section of the Provincial Court of Oviedo after a trial in which the Prosecutor’s Office and the accusation brought by Foro Asturias requested a sentence of three and a half years in prison.
This sentence was appealed by the Prosecutor’s Office and by Foro Asturias. The Prosecutor’s Office requested the repetition of the trial for the continued crime of misappropriation with a new court due to errors in the assessment of evidence and the violation of procedural rules or guarantees.
The Prosecutor’s Office and the accusation brought by Foro Asturias requested a sentence of three and a half years in prison, as well as compensation ranging from 181,000 to 218,000 euros. The accusations also requested compensation ranging from 181,000 euros to 218,000 euros for charging expenses they considered personal, related, for example, to trips or meals.
